Online Blood Tests may use Bloody Good Tests Pty Ltd as a third-party fulfilment and pathology coordination partner to assist with fulfilling orders, coordinating pathology request forms or referrals, liaising with laboratories and collection partners, supporting pathology testing workflows, storing or processing order and result information, and assisting with customer support relating to your test.

These Terms & Conditions of Use (Terms) apply to your access to and use of the Website and Services.

By accessing, browsing, purchasing from, or using the Website or Services, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not access or use the Website or Services.


2. Adults Only Service

The Website and Services are only available to individuals who are 18 years of age or older.

By accessing the Website, creating an account, placing an order, submitting information, or using the Services, you confirm that you are at least 18 years old.

You must not use the Website or Services if you are under 18 years of age.

You must not purchase tests, submit samples, request pathology services, or create an account on behalf of a person under 18 years of age.

Your pathology results may provide information about certain biomarkers or health indicators, but they do not by themselves provide a complete assessment of your health.

You should discuss your results with your regular GP or another appropriately qualified healthcare professional, especially if:

  • your results are abnormal;
  • you have symptoms;
  • you have an existing medical condition;
  • you are taking medication;

4. Suitability of the Services

You acknowledge that Online Blood Tests does not provide a complete medical assessment and does not replace a consultation with a doctor or other qualified healthcare practitioner.

We may refuse, cancel, delay, or recommend against providing Services where we reasonably believe that:

  • the Services are not appropriate for your circumstances;
  • the Services cannot be safely provided;
  • additional medical review is required;
  • your request should be managed by a healthcare professional in another setting;
  • required information has not been provided;
  • the Services are being requested for a person under 18 years of age; or
  • we are unable to provide the Services for legal, clinical, operational, or commercial reasons.

9. Orders and Services

Once your order is accepted, we may provide you with a pathology request form, referral, collection instructions, test kit, or other information required to access the Services.


10. Bloody Good Tests Fulfilment Partner

Online Blood Tests may use Bloody Good Tests Pty Ltd as a third-party fulfilment and pathology coordination partner.

By purchasing a test or service through Online Blood Tests, you acknowledge and agree that Bloody Good Tests Pty Ltd may assist with the fulfilment of your order, including by:

  • processing and fulfilling your order;
  • generating, managing, or coordinating pathology request forms or referrals;
  • liaising with laboratories and collection partners;
  • supporting pathology testing workflows;
  • receiving, storing, processing, or making available pathology results;
  • assisting with customer support relating to your test, referral, collection, or results;
  • coordinating operational, administrative, technical, and support services; and
  • otherwise assisting with the provision of the Services.

You consent to Online Blood Tests sharing your personal information and health information with Bloody Good Tests Pty Ltd where reasonably necessary to provide the Services.

You acknowledge that Bloody Good Tests Pty Ltd may work with laboratories, pathology providers, collection centres, healthcare professionals, technology providers, and other service providers to fulfil your order.

Where Bloody Good Tests Pty Ltd or any pathology provider, laboratory, collection centre, healthcare professional, technology provider, or other provider supplies services in connection with your order, those services may also be subject to that provider’s own terms, privacy policy, clinical requirements, operational requirements, and legal obligations.

Online Blood Tests is not responsible for delays, refusal of service, processing issues, laboratory issues, collection issues, technology issues, or other matters caused by third-party providers except to the extent required by law.


11. Pathology Request Forms and Referrals

Where a pathology request form or referral is issued to you, it must only be used for the tests purchased through the Website and in accordance with the instructions provided.

Unless otherwise stated:

  • pathology request forms and referrals are valid for 120 days from the date of order;
  • they are for single use only;
  • they must not be reused, altered, copied, transferred, or shared;
  • tests listed on one request form may not be split across multiple collection visits unless expressly permitted;
  • they must only be used at authorised collection centres, laboratories, or providers specified by us, Bloody Good Tests Pty Ltd, or our partners; and
  • additional fees may apply if a request form is used incorrectly, after expiry, at an unauthorised collection centre, or for tests not purchased through the Website.

We are not responsible for delays, refusal of service, or additional charges caused by incorrect use of a request form, attendance at an unauthorised collection centre, expired referrals, or failure to follow instructions.


12. Collection Centres and Third-Party Providers

Pathology collection, sample processing, laboratory testing, clinical review, reporting, payment processing, communications, fulfilment, customer support, and related services may be provided by independent third-party providers.

These may include:

  • Bloody Good Tests Pty Ltd;
  • pathology providers;
  • laboratories;
  • collection centres;
  • healthcare professionals;
  • technology platforms;
  • payment processors;
  • communications providers; and
  • other service providers.

You acknowledge and agree that:

  • third-party providers may have their own terms, policies, procedures, fees, eligibility requirements, and operating hours;
  • collection centre availability, locations, wait times, and procedures may change without notice;
  • some tests may not be available at all collection centres;
  • we do not control every aspect of third-party service delivery;
  • delays may occur due to laboratory processing times, sample quality, collection issues, public holidays, demand, technology issues, or other factors outside our control; and
  • third-party providers may refuse, delay, or be unable to provide services in certain circumstances.

13. Test Preparation and Sample Collection

Some tests may require specific preparation, including fasting, avoiding alcohol, avoiding certain medications or supplements, collecting a sample at a specific time, or following other instructions.

You are responsible for reading and following all preparation and collection instructions provided to you by Online Blood Tests, Bloody Good Tests Pty Ltd, pathology providers, laboratories, collection centres, healthcare professionals, or other relevant service providers.

Failure to follow instructions may affect the accuracy, reliability, or availability of your results.

We are not responsible for inaccurate, delayed, rejected, incomplete, or unavailable results caused by your failure to follow instructions.

You acknowledge that pathology collection may involve minor risks, including discomfort, bruising, bleeding, fainting, infection, or localised pain.


14. Test Results

Your results will usually be provided electronically, by email, through your account, through a third-party portal, or by another method made available to you.

Your results may be received, stored, processed, or made available by Online Blood Tests, Bloody Good Tests Pty Ltd, pathology providers, laboratories, healthcare professionals, or technology providers involved in providing the Services.

Indicative result timeframes may be provided, but they are estimates only.

Some tests may take longer than others.

We do not guarantee that results will be available within a specific timeframe.

Results may include reference ranges, flags, comments, or general information. Any comments, explanations, or interpretations are for general informational purposes only and are not a diagnosis.

Results are generally displayed with reference ranges supplied by the reporting laboratory. These reference ranges are provided for context only and do not constitute medical interpretation, diagnosis, treatment advice, or a recommendation about your care.

The significance of a result depends on your individual circumstances and should be discussed with your usual GP or another appropriately qualified healthcare professional.

Where significantly abnormal or clinically concerning results are identified, a healthcare professional, laboratory, Bloody Good Tests Pty Ltd, pathology provider, or other third-party provider may contact you or recommend that you seek medical care.

However, you remain responsible for seeking medical advice about your results.

15. Critical and Abnormal Results

Online Blood Tests may use Bloody Good Tests Pty Ltd to assist with results management, clinical governance, and escalation processes.

A critical result is a laboratory finding that, in the opinion of the reporting laboratory, may represent an immediate or significant risk to a person’s health if not acted upon promptly.

What constitutes a critical result is determined by the reporting laboratory and may vary depending on the test performed, the degree of abnormality, the clinical context, and laboratory-specific policies.

Where a reporting laboratory formally notifies Bloody Good Tests Pty Ltd of a critical result, Bloody Good Tests Pty Ltd may arrange for the result to be reviewed by an appropriately qualified clinician and may contact you directly using the contact details provided with your order.

You consent to Online Blood Tests, Bloody Good Tests Pty Ltd, pathology providers, laboratories, healthcare professionals, and related service providers contacting you by phone, SMS, email, or other available contact methods in relation to critical, urgent, abnormal, or clinically significant results.

Bloody Good Tests Pty Ltd may make multiple attempts to contact you where clinically appropriate. You are responsible for ensuring that the contact details you provide are accurate, current, and accessible.

A non-critical abnormal result is a result that falls outside the laboratory’s stated reference range but has not been classified by the laboratory as critical.

Unless expressly stated otherwise, Online Blood Tests and Bloody Good Tests Pty Ltd do not routinely contact customers about non-critical abnormal results. Non-critical abnormal results may still be clinically significant depending on your symptoms, medical history, medications, trends over time, and other factors.

You are responsible for reviewing your results and discussing them with your usual GP or another appropriately qualified healthcare professional. This is especially important where your results are abnormal, you have symptoms, you have an existing medical condition, or you have any concerns about your health.

Online Blood Tests and Bloody Good Tests Pty Ltd do not provide diagnosis, treatment advice, medical management, or ongoing clinical care.

16. No Doctor-Patient Relationship with Online Blood Tests

Unless expressly stated otherwise, your use of the Website or Services does not create a traditional doctor-patient relationship between you and Online Blood Tests.

Where a doctor, pharmacist, pathology provider, laboratory, or other healthcare professional provides a clinical service, that service may be provided by an independent third party and may be subject to their own professional obligations, clinical judgement, and terms.

Online Blood Tests does not guarantee that any particular test is appropriate for your individual circumstances.


17. Payments

All prices are listed in Australian dollars unless otherwise stated.

You agree to pay all fees, charges, and taxes applicable to your order.

Payments may be processed by third-party payment providers. By making a payment, you agree to comply with the terms and conditions of the relevant payment provider.

We may vary prices, fees, inclusions, and Services at any time. Changes will not affect orders already accepted unless otherwise permitted by law.

If your payment is declined, reversed, charged back, or otherwise not received, we may suspend, cancel, or delay the relevant Services and recover any costs, fees, or charges incurred.


18. GST

Where applicable, prices may include GST.

If GST applies to your purchase, it will be charged in accordance with Australian tax law.

You are responsible for ensuring your contact details are accurate and up to date.

We are not responsible for missed communications, delays, or failure to receive results or instructions caused by incorrect contact details, spam filters, email issues, phone issues, or third-party platform issues.

You agree to indemnify New Site Ventures Pty Ltd, Online Blood Tests, and our officers, employees, contractors, agents, suppliers, partners, and licensors from and against any loss, liability, claim, demand, damage, cost, or expense arising from or connected with:

  • your breach of these Terms;
  • your misuse of the Website or Services;
  • your provision of false, incomplete, or misleading information;
  • your failure to follow test preparation, collection, or referral instructions;
  • your misuse of pathology request forms, referrals, or results;
  • your attendance at an unauthorised collection centre;
  • your use of Services for another person without authority;
  • your use of Services for a person under 18 years of age;
  • your breach of law or third-party rights;
  • any harm, injury, discomfort, bruising, infection, pain, or other issue arising from sample collection or testing, except to the extent caused by our negligence or breach of law;
  • your failure to seek appropriate medical advice; or
  • your failure to share relevant results with a GP or other healthcare professional.

32. Suspension and Termination

We may suspend, restrict, or terminate your access to the Website or Services if:

  • you breach these Terms;
  • we suspect fraud, misuse, unauthorised access, or unlawful activity;
  • you are under 18 years of age;
  • we believe the Services are being requested for a person under 18 years of age;
  • payment is declined, reversed, or charged back;
  • we are required to do so by law;
  • Bloody Good Tests Pty Ltd, a pathology provider, laboratory, collection centre, healthcare professional, technology provider, or other service provider is unable or unwilling to provide a relevant service;
  • continuing to provide the Services is no longer commercially, technically, legally, operationally, or clinically viable; or
  • your conduct may harm us, our users, third-party providers, or our reputation.

You may stop using the Website at any time.

Termination does not affect any rights or obligations that accrued before termination.

If your complaint relates to services fulfilled or coordinated by Bloody Good Tests Pty Ltd, a pathology provider, laboratory, collection centre, healthcare professional, or other service provider, we may need to share relevant information with that provider to investigate and respond to your complaint.


34. Dispute Resolution

If a dispute arises in connection with these Terms, the Website, or the Services, either party must first give the other party written notice describing:

  • the nature of the dispute;
  • the desired outcome; and
  • the action requested to resolve the dispute.

The parties must then use reasonable endeavours to resolve the dispute in good faith within 28 days of the notice.

If the dispute is not resolved within 28 days, the parties may agree to mediation in Victoria, Australia.

If the parties cannot agree on a mediator, either party may request that a mediator be appointed by an appropriate mediation body in Victoria.

Each party must bear its own costs of the dispute resolution process, and the parties will share the mediator’s fees equally unless otherwise agreed.

Nothing in this clause prevents either party from seeking urgent interlocutory relief.


35. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia, and any courts entitled to hear appeals from those courts.


36. Severability

If any part of these Terms is found to be void, invalid, unlawful, or unenforceable, that part will be severed to the extent necessary.

The remaining provisions will continue in full force and effect.


37. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Subscription Policy, Results Management & Clinical Escalation page, and any other policies, notices, or terms published on the Website, form the agreement between you and us in relation to your use of the Website and Services.
